Terms and Conditions

These terms are the contract for watchingoverbaby.com. They say, in particular, what the service covers and what it does not cover if something goes wrong with a child.

1. Agreement

By creating an account, signing in, paying, or inviting a caregiver, you agree to these terms and the Privacy Policy. If you use the service for a child, you confirm you are a parent, legal guardian, or someone the parent has authorised to help care for that child.

These terms are written for parents. They are not a substitute for advice from your own solicitor. Mandatory consumer rights in your country still apply, including any right we are not allowed to take away.

2. What the service is

Watching Over Baby is software: a web viewer, optional phone apps when we offer them, two-way talk, noise and motion alerts, and, on paid plans, cry labelling, history, sleep summaries, and extra caregiver seats. It shows information to the people you allow into that nursery.

It does not watch the child for you. It does not diagnose illness, breathing, suffocation, or distress. It is not cleared or certified as a medical device by the FDA, MHRA, or any other regulator, and it is not sold as one.

3. What is covered

If you pay, the fee covers only the software features of the plan you chose, for the period you paid for:

  • Basic: live viewing up to 720p, two-way talk, standard noise and motion alerts, and two accounts.
  • Pro: the Basic features, plus cry-versus-noise labelling, rollover and covered-face style alerts, 30-day history, sleep reports, web dashboard tools, and up to ten caregiver profiles.
  • Pro+: the Pro features, plus more caregiver seats, breathing and chest-motion style cues where that plan lists them, and the integrations named on the pricing page.

The commercial remedy, if a paid feature is unavailable for a material part of a billing period because of our software, is a refund or credit of the unused fees for that period. That is the full remedy for a service failure, except where section 11 says the law requires more.

Support covers help using the account, billing, and caregivers. It does not cover emergency response, medical advice, or a promise that an alert will fire.

4. What is not covered

The fee does not buy protection of a child. The following are outside the service, whether or not you paid:

  • Death, injury, illness, or distress of a child or anyone else, including from a missed, late, wrong, or absent alert.
  • A failed, frozen, delayed, or blurry video or audio stream.
  • False alarms, and real events the software does not flag.
  • AI labels that are wrong, including calling a cry “noise” or noise a “cry”.
  • Your camera, phone, tablet, computer, power, Wi-Fi, mobile data, or a device that sleeps, locks, or loses notification permission.
  • Outages of our host, Stripe, Google, X, Apple, or any other supplier.
  • A caregiver you invited who misses an event, shares access, or uses the nursery badly.
  • Any decision you or a caregiver make about a child’s care, sleep position, bedding, or whether to go into the room.
  • Loss of recordings, settings, or history.

Breathing cues, chest-motion cues, and cry detection are indicators only. They are not apnea monitors, pulse oximeters, or hospital equipment. A “normal” status does not mean the child is safe.

5. You must not rely on it alone

You agree that a responsible person must still be able to check the child directly. Do not leave a child in the sole care of this service, a phone notification, or a grandparent watching only through the viewer. Follow safe-sleep guidance from a qualified health authority, not from the app.

You accept that the product can fail at the moment you need it. Using it means you understand that risk and you choose to use it anyway as a secondary aid.

6. Accounts and caregivers

You must use a real email and keep sign-in private. You are responsible for every person you invite and for the role you give them: Admin, Viewer, or local Wi-Fi only. Removing them in the product stops their access going forward. It does not undo what they already saw.

We may suspend an account that misuses the service, tries to open another family’s nursery, or shares footage without the right to do so. Suspension does not create a duty for us to keep watching the child.

7. Plans, payment, and cancellation

Basic is free. Pro and Pro+ renew monthly or annually until you cancel in Billing. Annual prices include two months. Stripe processes cards. Visa and Mastercard are accepted. We do not store full card numbers. If payment fails or you cancel, paid features stop and the nursery returns to Basic. Fees already due are not a deposit against harm.

8. Acceptable use and privacy

Do not monitor someone without a lawful basis, harass anyone, or upload what you have no right to share. Nursery names, caregiver emails, sleep summaries, and alert history are kept for the account. Footage is not sold and is not used for advertising. See the Privacy Policy.

9. No warranty of safety or uptime

The service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, timely, secure, or error-free, or that alerts, cry detection, motion detection, or video will work in your home. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent the law allows. Nothing in this section removes a statutory right that cannot legally be disclaimed, including rights under consumer law where you are a consumer.

10. Apps

The web viewer is available now. App Store, Google Play, and Microsoft apps, if offered later, are the same service and the same limits. A store listing does not make the product a certified safety device.

11. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law of your country says we cannot exclude.

Subject to that, we are not liable for death, injury, illness, missed events, emotional distress, loss of chance, or any indirect or consequential loss arising from use of, or failure of, the service. Our total liability for any other claim in a twelve-month period is limited to the fees you paid us for the service in that period. If you paid nothing, that cap is zero, except where a statute requires a different minimum.

You use the service on the understanding that this cap and these exclusions are a fair allocation of risk for a low-cost software aid, and that the price would be different if we insured a child’s life.

12. Your responsibility to us

If someone claims against us because of how you used the nursery, who you invited, or footage you had no right to share, you will cover the loss we actually suffer because of that claim, except to the extent it was caused by our own negligence.

13. Changes and the whole agreement

We may update these terms by posting a new version on this page. If a change is material, we will say so in the product before it applies to a new billing period. The posted terms are the whole agreement about the service. A chat message, advertisement, or “peace of mind” line does not add a safety guarantee.

If a court holds one sentence unenforceable, the rest stays in force. These terms are governed by the law of the country where you live, and the courts of that country, without reducing any mandatory protection you have as a consumer.

14. Contact

Questions about these terms go through Support. Support is not an emergency line. For a child in danger, contact local emergency services.
